TfP Photoshoot Agreement
§1 Photography
The photographer and the model agree to collaborate on a time-for-photos (TFP) basis. The model will participate in a photo shoot, during which photographic works will be created.
§2 Rights of Publication
Both parties agree that the resulting images may be used and published by both the photographer and the model without any limitation in terms of time, location, or content. Neither party shall assert any claims against the other, or against third parties, in the event of publication.
§3 Personal Rights & Name Attribution
Both parties commit to respecting each other’s personal rights. The images may only be edited or published in ways that preserve these rights. Name attribution of the model lies at the discretion of the photographer, unless otherwise agreed in writing. The model is required to credit the photographer by name in any public or online publication of the images (e.g., tagging on social media, printed features, websites), unless otherwise agreed in writing. Name attribution of the model remains at the photographer’s discretion.
§4 Compensation
No monetary compensation shall be exchanged between the parties.
The model receives a selection of edited or unedited images for personal, non-commercial use (e.g., portfolio, website, sedcards).
The photographer likewise retains the right to use the images for personal promotion (e.g., portfolio, website, exhibitions).
Commercial sale or transfer of the images to third parties is not permitted by either party unless explicitly agreed in writing.
§5 Amendments & Severability
Any changes, additions, or side agreements must be made in writing. This also applies to any waiver of this written form requirement. Should any clause of this agreement be or become invalid, the validity of the remaining provisions remains unaffected.
